Welcome to Brew Gallery. These Terms of Service ("Terms") govern your use of thebrewgallery.com.au (the "Site") and any purchase you make through it. Brew Gallery Pty Ltd ("we", "us", "our") operates the Site.

By accessing or using the Site, or making a purchase through it, you agree to these Terms. If you don't agree, please don't use the Site.

Products, Pricing & Availability

●        We make every effort to ensure product descriptions, images, and pricing are accurate, but errors can occur. We reserve the right to correct pricing or product information at any time, and to cancel an order affected by a pricing error, in which case you'll receive a full refund.

●        All prices are in Australian Dollars (AUD) and include GST where applicable, unless stated otherwise.

●        Product availability is not guaranteed until your order is confirmed. If an item you've ordered is out of stock, we'll contact you to arrange a refund, backorder, or substitute.

●        Product images are for illustrative purposes; actual colour and finish may vary slightly from what's displayed on your screen.

 

Orders & Payment

●        Placing an order is an offer to purchase; we're not obligated to accept any order, and we may decline or cancel an order at our discretion (for example, in cases of suspected fraud or pricing errors).

●        Where we accept your order, these Terms apply and form an agreement between us for the purchase of the products ordered.

●        You can't cancel or vary an order once placed without our agreement.

●        Payment is required in full at the time of order via the payment methods available at checkout, unless otherwise agreed.

●        You're responsible for providing accurate order, shipping, and payment information.

●        We currently only accept and process orders from within Australia.

 

Ownership & Risk

Ownership of the products remains with us until you've paid the full price. Risk in the products (e.g. responsibility for loss or damage) passes to you on delivery.

 

Force Majeure

We won't be liable for any delay or failure to perform our obligations where this is due to a cause reasonably beyond our control.

 

Shipping & Delivery

Shipping costs, timeframes, and delivery conditions are set out in our Shipping Policy. Delivery estimates are not guaranteed and may be affected by factors outside our control.

 

Returns & Warranty

Change-of-mind returns, faulty items, and manufacturer warranty claims are governed by our Returns & Warranty Policy. Nothing in these Terms limits your rights under the Australian Consumer Law, which cannot be excluded.

 

Intellectual Property

All content on the Site — including text, images, logos, graphics, and product descriptions — is owned by or licensed to Brew Gallery Pty Ltd and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any Site content without our prior written permission.

●        Attempt to damage, disable, overburden, or interfere with the Site's operation or security

Limitation of Liability

●        Brew Gallery Pty Ltd's liability for any claim arising from your use of the Site or purchase of products is limited, at our option, to the repair or replacement of the goods, or the supply of equivalent goods.

●        We're not liable for any indirect, incidental, or consequential loss or damage arising from your use of the Site or products purchased through it.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

 

Indemnity

You agree to indemnify Brew Gallery Pty Ltd against any claims, losses, or expenses arising from your breach of these Terms or misuse of the Site.

 

Changes to These Terms

We may update these Terms from time to time. The current version will always be available on the Site, and continued use of the Site after changes take effect means you accept the updated Terms.

 

Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
